Insurance & Personal Injury Evidence

Insurance and Personal Injury Digital Evidence Analysis

Digital evidence can corroborate, contradict, or place limits around a claimed sequence, but photographs, videos, messages, and device records need source context.

Original files

A copy may not preserve what the original file contained.

Insurance and personal injury matters often rely on photographs, videos, screenshots, text messages, phone activity, claim submissions, repair communications, location information, or files produced after the event. Those records can be useful, but their value depends on how they were created, stored, exported, transferred, and preserved.

Messaging platforms, social media, cloud services, export tools, and file sharing services may strip metadata or create new dates that reflect transmission rather than capture. Forensic review distinguishes the original record from later copies when the evidence allows it.

Original source

Native photo, video, or record

May preserve capture time, device details, file path, embedded metadata, application data, and surrounding records.

Derivative copy

Export, screenshot, or forwarded file

May show useful content but can lose metadata, alter dates, change file names, or obscure the original source.

Metadata interpretation

Metadata can help, but it needs careful limits.

Chronology

The review should follow the sequence, not a preferred outcome.

Forensic work in insurance and injury matters should remain objective. The same records may support part of a claim, undermine part of a claim, or show that the available data cannot answer the question with certainty.

The relevant period may be minutes, not months, and device activity is not always human activity. A phone can log a notification or connect to a vehicle without proving what a person saw, intended, or did.

  1. Before

Prior files, communications, travel and navigation, device activity, account records, and baseline system information.

  2. Event window

Photos, videos, calls, messages, notifications, location records, application activity, vehicle connections, and device usage.

  3. After

Claim communications, uploads, forwards, edits, exports, duplicates, cloud sync, and later productions.
